Don’t Get Burned by Open Burning

Open burning of any type involves the burning of materials in which air contaminants are emitted directly into the air without first passing through a stack or chimney.

Unincorporated residents of Clay County within the fire district are required to obtain an open burn permit from Kearney Fire & Rescue Protection District.

In the city limits of Kearney, you are only allowed to burn vegetable or flower gardens and agricultural fields. You are not allowed to burn any sweepings, trash, paper, lumber, straw, hay, leaves, or any other combustible material.

Kearney Fire & Rescue Protection District issues burn permits to portions of unincorporated Clay County residents inside the fire district jurisdiction.

Note: Burn permits are not issued to residents inside the city limits of Kearney due to the city’s No Burning ordinance.

In order to burn in the Kearney Fire & Rescue Protection District, you need to fill out and submit a Burn Permit. Information provided within the permit will include:

  • Address
  • Property Owner
  • Phone Number
  • Email
  • Materials requesting to burn
  • Distance to nearest structure
  • Individual who will control the burn

On the back of the burn permit are Rules & Regulations of the permit. The Kearney Fire District is considered part of the Mid-America Regional Council Group, so we ask that you restrict your burning to “Green Days” in accordance with the EPA Air Quality Index.
