In order to burn in the Kearney Fire & Rescue Protection District you need to fill out and submit a Missouri DNR Burn Permit to the Kearney Fire Department. We then forward it on to Missouri DNR for Final approval (usually takes a few days) you should receive a copy in the mail to confirm approved or denied. For City Regulations click here.

Nothing in this fact sheet may be construed to permit open burning that causes or constitutes a public health hazard, nuisance or a hazard to vehicular or air traffic or violates any other rule or statute.

- Kansas City metropolitan area:
- The geographical area comprising Jackson, Cass, Clay, Platte, Ray and Buchanan counties.
- Kansas City metropolitan area:
- Open burning is allowed provided the burning takes place within an area zoned for agricultural purposes and outside the portion of the metropolitan area surrounded by the corporate limits of Kansas City and every bordering municipality and outside the portion of the metropolitan area surrounded by the corporate limits of St. Joseph.
Prohibited Open Burning Under State Regulation
Any waste generated by a business, trade, industry, or any demolition operation cannot be burned. This would include, but is not limited to paper, cardboard boxes, pallets, tires, rubber products, hazardous materials, styrofoam, plastics, petroleum based products and treated wood. Any asbestos-containing material cannot be burned.
Allowable Open Burning Under State Regulations (Local governments may have stricter laws and policies)
- Open Burning of Household Refuse
- Missouri allows open burning of household refuse originating on premises from four dwelling units or less and burned on the same premises. Materials such as tires or waste oil may not be used to start the fires or be burned in the fires in the Kansas City metropolitan area
- Open Burning of Household Yard Wastes
- Missouri allows open burning of household yard wastes originating on premises from four dwelling units or less and burned on the same premises. Materials such as tires or waste oil may not be used to start the fires or be burned in the fires in the Kansas City metropolitan area.
- Open Burning in Agricultural Operations
- Missouri allows agricultural burning throughout the state. However, several exceptions apply. Materials such as tires or waste oil may not be used to start the fires or be burned in the fires. Any burning which produces smoke in such a manner as to impair visibility for those operating motor vehicles or airplanes is prohibited. Any open burning which creates a health hazard is also prohibited.

A. No person shall burn or cause to be burned any sweepings, trash, paper, lumber, straw, hay, leaves or any combustible material with the exception of
1. Vegetable or flower gardens may be burned.
2. Agricultural fields may be burned.
The burning of the above exceptions shall only be allowed between the hours of sunrise and sunset and person in charge of fire shall be in constant attendance with a water supply ready to quench the fire if same is within twenty (20) feet of a structure.
B. Nothing in this Section shall prevent the making of fires on proper occasions, providing permission is first obtained from the Chief of the Fire Department.
C. The use of the term "Fire Chief" in this Section shall mean the Fire Chief of the Kearney Fire and Rescue Protection District unless the Board of Aldermen designates otherwise.
D. Any person violating the provisions of this Section shall upon conviction thereof be punished by a fine not exceeding one hundred dollars ($100.00) for each such violation. (Ord. No. 476-87 §§2--4, 8-24-87; Ord. No. 548-91 §1, 6-17-91)
